Artwork Ownership

All custom work designed by Lavender Moon Design is unique and will never be duplicated for another business or individual. The designer retains personal rights to use the completed project and any preliminary designs for the purpose of design competitions, future publications on design, educational purposes and the marketing of the designer's business. Where applicable, the client will be given any necessary credit for usage of the project elements.

Confidentiality

All correspondence and documents provided will be treated as confidential between the client and the designer, unless consent has been granted by both parties involved.

Quotes

Price quotes are good for thirty (30) days, after which time quotes are subject to review.

Payment

A deposit in amount as indicated to you by the designer, is due before work on the project commences. In the case that extra revisions are to be made, final payment is due before the project is finalised and loaded on the website.

Cancellation

In the event of cancellation of the project, the deposit will be kept as a cancellation fee. After work begins on a design project, any fees that have been paid are nonrefundable.

Proofing of Final Project

The designer shall make every effort to ensure the final product is free of any errors, before giving the final product to the client. It is agreed that it is the client's responsibility to ensure that there are no visible errors contained in the final product. It is agreed that the designer is not responsible or held liable for any errors contained in the final product after the final product has been committed to print or posted in view of the public.

Any errors or problems with a design or website must be reported within fifteen (15) days of completion of the project. After that 15 day period, fees or an hourly rate will be applied to any revision.

Disclaimer of Warranties

Lavender Moon Design assumes no responsibility for errors or omissions in these materials. THESE MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Lavender Moon Design further does not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within these materials. Lavender Moon Design shall not be liable for any special, indirect, incidental, or consequential damages, including without limitation, lost of revenues or lost profits, which may result from the use of these materials. The information on this server is subject to change without notice and does not represent a commitment on the part of Lavender Moon Design in the future.

Indemnity Agreement

The client further agrees to indemnify and hold harmless Lavender Moon Design for claims of any nature whatsoever pertaining to the services and goods provided. This includes the loss of customer furnished proofs and materials, loss of profits, business interruption and loss of any information stored in Lavender Moon Design's computers. Additionally, this Indemnity Agreement includes claims relating to any software or other copyrightable materials furnished by the client, and from any and all copyright claims and/or misappropriations of trade secrets and/or any claim of theft of proprietary information.
