mygoogle.co.za provides online personal and business websites. mygoogle.co.za Terms and Conditions are provided online. Clients use of their websites pages shall be deemed to be clients acceptance of posted terms and conditions.

1. The "Client" retains mygoogle.co.za, and mygoogle.co.za agrees to perform the following services:
   designing or redesigning, and/or building, and/or maintaining a website as a subdomain from mygoogle.co.za for the Client according to “specifications agreed upon” between mygoogle.co.za and Client. Mygoogle.co.za will act as the prime contractor for the development and will sub-contract specific portions of the task as and when required.
2. Development of website requested from client will ONLY begin upon payment of 1st monthly payment as per package chosen. (proof of payment required), debit order form received and signed by client and sent back to mygoogle.co.za.
3. It shall be the responsibility of the client to ensure that all data and content assets supplied to mygoogle.co.za are legally permitted for use, and that any restrictions on use or necessary copyright notices are notified in writing to mygoogle.co.za. Mygoogle.co.za accepts no liability for breach of copyright or other intellectual rights on data included in the finished product.
4. The completed website may include executable code from other sources. Mygoogle.co.za will ensure that it has the necessary rights to use such code. The intellectual property rights associated with the user interface, screen designs and the overall ‘look and feel’ of the website remain the property of mygoogle.co.za.
5. The website samples on mygoogle.co.za do not represent the final product of the client.
6. Everything given from mygoogle.co.za to the client will stay the property of mygoogle.co.za and mygoogle.co.za will have ownership on all subdomain names and websites developed for the clients.
7. Once development work has begun, changes and additions to the required tasks will only be accepted by negotiation with mygoogle.co.za.
8. The client is solely responsibility for supplying mygoogle.co.za with all necessary text, graphics and other documentation needed to perform the contracted services. Delays caused by non-delivery of materials or non-completion of agreed tasks by the client may result in additional charges by mygoogle.co.za.
9. Payment to mygoogle.co.za will be via debit order between the 1st and 3rd of each month in advance as per the agreed package.
10. Failure to pay the fees by your due date will result in your website being suspended until payment is made in full. Failure to pay late payments thats more than 60 days old will result in your website being cancelled.
11. This agreement may be terminated at any time by the client, provided such termination is notified in writing to mygoogle.co.za
12. This agreement may be terminated at any time by mygoogle.co.za with 30 days written notice.
13. Clients will be charge R250.00 per hour if they need to update their website.
14. Travel expenses for necessary meetings and approved journeys undertaken by any staff member of mygoogle.co.za will be charged to the client at cost.
15. All intellectual property rights associated with any original computer software source code developed under this agreement remain the property of mygoogle.co.za.
16. None of mygoogle.co.za website designs/developments including source code may be sold or given to anyone outside mygoogle.co.za.
17. Mygoogle.co.za undertakes to promote the client through SEO, search engines and its own niche market directories.
18. Mygoogle.co.za provides no guarantees regarding sales, business or leads generated.
19. Clients shall not lease, sublease, or assign the web site without the prior written consent of mygoogle.co.za (but this consent shall not be withheld unreasonably).
20. Mygoogle.co.za may access the web site for the purposes of inspection, maintenance, or repair.
21. The Client shall, upon termination, lose all right to the web site, domain name and content supplied by mygoogle.co.za.
22. In a dispute between mygoogle.co.za and the Client which gives rise to any action in court, the losing party will pay the court costs and reasonable attorney fees of the successful party.
23. We regard the safety and privacy of children using this web site extremely seriously but it remains the ultimate responsibility of the parents and other care-givers of children to ensure that they are not exposed to inappropriate content or behaviour.
24. Mygoogle.co.za will not tolerate the inclusion of any website containing content that might be damaging or derogatory to certain adult viewers and children. The likes of extreme violence, sexual content, gore, pornography and any other content that we might deem damaging to our viewers.
25. Mygoogle.co.za recognises and acknowledges that this Agreement creates a confidential relationship between mygoogle.co.za and Client and that information concerning Client’s business affairs, customers, vendors, finances, properties, methods of operations, computer programs, and documentation, and other such information, whether written, oral, or otherwise, is confidential in nature.
26. Mygoogle.co.za agrees that, except as directed by Client, it will not at any time during or after the term of this Agreement disclose any Confidential Information to any person whatsoever and that upon the termination of this Agreement it will turn over to Client all documents, papers, and other matter in its possession or control that relate to Client.
27. Mygoogle.co.za does not warrant that the functions contained in these Web pages or the Internet website will meet the client's requirements or that the operation of the Web pages will be uninterrupted or error-free. The entire risk as to the quality and performance of the Web pages and website is with client. In no event will mygoogle.co.za be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
28. Client certifies that he or she is at least 18 years of age.
29. Client agrees that mygoogle.co.za may put a byline and hyperlink on the bottom pages of their website establishing authorship credit and copyright notice and that mygoogle.co.za may advertise client's website as an example of their work.
30. Mygoogle.co.za will not be responsible for customer errors, loss of data, viruses or corruption of files.
31. Any products or services not specified in this contract are not required of mygoogle.co.za.
